KAREL CASLAVSKY ONLINE / LEGAL

Website Development Terms of Service

Last updated: 17-Oct-2026

These Website Development Terms of Service explain how Karel Caslavsky Online (KCO) approaches website planning, development, project delivery and the responsibilities of both parties.

Our objective is to establish clear expectations, properly defined work and professional website delivery.

These terms apply alongside an accepted project quotation or agreement. Where specific arrangements differ, the accepted agreement determines the applicable project requirements, subject to mandatory law.

1. Website Development Services

KCO provides WordPress-based website design and development for businesses requiring professional, practical and maintainable online platforms.

Depending on the agreed scope, projects may include:

  • Fast-launch websites for smaller businesses.
  • Custom business websites.
  • Landing pages and campaign websites.
  • WooCommerce online stores.
  • Bespoke website development.
  • Redesign and redevelopment of existing websites.

Each project is developed according to its approved requirements, content, technical needs and commercial arrangements.

Not every feature described on KCO’s website is included in every project.

2. Project Discovery and Enquiries

Before preparing a quotation, KCO may request information about the client’s business, audience, objectives, content, required functionality and technical expectations.

Initial enquiries may be handled by Yumi, KCO’s AI business assistant.

Project discovery may involve:

  • Business objectives and intended audience.
  • Website type, structure and required pages.
  • Branding, imagery and written content.
  • Online store and payment requirements.
  • Forms, bookings, memberships and integrations.
  • Hosting and infrastructure requirements.
  • Expected delivery timeframe.
  • Budget and project constraints.

Where information is incomplete, KCO may issue an indicative estimate based on clearly stated assumptions.

Such estimates are not binding fixed-price commitments unless expressly confirmed in an accepted quotation.

3. Quotations and Project Scope

Each project is governed by an approved quotation or agreement defining the work to be undertaken.

The quotation may specify:

  • Website type and agreed deliverables.
  • Number of pages or content sections.
  • Included design and development work.
  • Client-supplied and KCO-prepared content.
  • Approved integrations and additional functionality.
  • Hosting, domain and licence arrangements.
  • Project charges and payment milestones.
  • Expected delivery stages and timeframes.
  • Relevant exclusions and assumptions.

Only the work expressly included in the accepted scope is covered by the agreed project price.

Additional pages, functionality, content preparation, integrations or substantial changes may require a separate quotation or approved variation.

4. Project Acceptance and Commencement

Development begins once the applicable quotation or agreement has been accepted and any agreed commencement requirements have been satisfied.

These requirements may include payment of an agreed deposit, provision of essential project information or confirmation of technical arrangements.

KCO is not required to begin chargeable development before the agreed commencement conditions have been met.

Quotations accepted after their stated validity period may require reconfirmation of pricing, scope and availability.

5. Client Responsibilities

The client is responsible for supplying the information, decisions, materials and permissions reasonably necessary to complete the project.

These may include:

  • Accurate business and contact information.
  • Branding materials, logos and visual assets.
  • Approved written content and imagery.
  • Product information, prices and specifications.
  • Applicable business policies and legal notices.
  • Necessary account access through approved secure channels.
  • Timely feedback and project decisions.
  • Approval of content, design and functionality.
  • Confirmation of lawful usage rights for supplied materials.

Unless content preparation is included in the quotation, responsibility for supplying and approving that material remains with the client.

Delays in supplying essential information or approvals may affect delivery schedules.

The client must not knowingly provide material that infringes third-party rights or breaches applicable law.

6. Design and Development

KCO develops websites using WordPress and appropriate supporting technologies.

Work may include information architecture, custom design, responsive layouts, HTML, CSS, JavaScript, WordPress configuration and approved specialist functionality.

KCO does not ordinarily construct websites from generic premade package layouts or conventional page-builder templates.

The technical approach is determined by the approved project requirements.

Custom PHP development, specialist applications, unsupported integrations and unusually complex functionality are assessed separately where required.

KCO may select suitable development methods and supporting technologies consistent with the approved scope.

7. Responsive Design and Compatibility

Website development ordinarily includes appropriate consideration of desktop, tablet and mobile presentation.

Testing is performed against the browsers, devices and technical environments reasonably included in the approved project scope.

Minor visual differences may occur between browsers, operating systems, devices and screen sizes.

Compatibility with obsolete, unsupported or specialist environments is not included unless expressly agreed.

Third-party browser updates, operating-system changes and external integrations may affect website behaviour after delivery.

8. Content Preparation and Approval

Where KCO is commissioned to prepare written content, product descriptions or supporting materials, the relevant deliverables must be defined in the accepted scope.

Content is prepared from information supplied or approved by the client.

The client remains responsible for checking factual statements, business claims, product specifications, prices and legal information before publication.

Additional content preparation outside the approved scope may incur separate charges.

KCO may decline to publish material that presents significant legal, security or operational concerns.

9. Revisions and Change Requests

The approved quotation or agreement determines the revisions, review stages and alterations included in a project.

Requests that clarify or correct work within the agreed scope are distinguished from requests that materially expand or change that scope.

Additional pages, substantial redesigns, new integrations or changes to previously approved functionality may require a revised quotation.

KCO will communicate material additional charges before undertaking separately chargeable work.

Changes requested after final approval or launch may be treated as new work or ongoing maintenance, depending on their nature and the applicable agreement.

10. Project Timelines and Delays

Any agreed delivery timeframe is based on the project scope, technical requirements, availability of essential materials and reasonable cooperation between the parties.

Timelines may change where:

  • Essential content or approvals are delayed.
  • The approved scope is expanded.
  • Third-party systems or providers introduce delays.
  • Unexpected technical difficulties require further investigation.
  • Events outside reasonable control affect delivery.

KCO will communicate material changes to the expected delivery schedule where reasonably practicable.

A specific guaranteed completion date applies only where expressly agreed.

11. Third-Party Services and Licences

Website projects may require third-party products or services, including domains, hosting, payment gateways, premium plugins, software subscriptions or external integrations.

Included services and third-party charges are defined in the approved quotation.

Additional licences, subscriptions, usage charges and renewals are charged according to the applicable commercial arrangements.

Third-party providers remain responsible for their own products, policies, availability and service conditions.

KCO cannot guarantee the uninterrupted availability or permanent compatibility of independently operated third-party services.

12. Hosting and Infrastructure

New KCO-developed websites are ordinarily deployed to separately provisioned VPS environments sized according to the project’s requirements.

Hosting arrangements may include domain services, SSL configuration, CDN support, backups and appropriate security measures, where included in the accepted scope.

Hosting and infrastructure services may be subject to recurring charges and additional service conditions.

Detailed hosting, renewal, maintenance and operational responsibilities are addressed in our Hosting, Maintenance & Support Terms.

13. Testing and Client Review

Before launch, KCO undertakes testing appropriate to the approved project scope.

Testing may include responsive presentation, navigation, forms, basic functionality, essential technical configuration and approved integrations.

The client may be asked to review the website and identify material issues before final approval.

Client approval confirms acceptance of the relevant deliverables, subject to agreed outstanding corrections and applicable legal rights.

Testing cannot guarantee the absence of every possible software defect or future compatibility issue.

14. Website Launch and Handover

Website launch takes place when the applicable approval, technical and payment conditions have been satisfied.

Launch may involve domain configuration, hosting deployment, SSL verification, final checks and publication of the approved website.

Any handover documentation, credentials, training or administrative access is governed by the agreed scope and security arrangements.

The completion of website development does not automatically include unlimited future maintenance, content changes or technical support.

Ongoing care must be covered by the applicable maintenance agreement or separately approved work.

15. Intellectual Property and Ownership

The ownership and licensing of commissioned deliverables are determined by the accepted quotation or project agreement, subject to applicable intellectual property law.

Client-supplied materials remain the property of their respective owners.

Third-party software, WordPress, plugins, themes, libraries and other licensed components remain subject to their respective licence terms.

KCO retains rights in its pre-existing materials, reusable development methods, internal tools, proprietary systems and other intellectual property unless expressly agreed otherwise.

Transfer or licensing of project-specific deliverables, including any conditions linked to payment, must be established in the relevant agreement.

No provision in these terms transfers ownership of third-party intellectual property contrary to its applicable licence.

16. Payments and Additional Charges

Project charges, deposits, instalments, due dates and payment conditions are determined by the accepted quotation or agreement.

Additional work outside the approved scope must be quoted or otherwise authorised before becoming separately chargeable.

Third-party services, licences, renewals and external-provider charges may be billed separately where applicable.

Payment obligations and cancellation arrangements are further addressed in our Refunds, Cancellations & Payments Policy.

Nothing in these terms overrides mandatory consumer or statutory rights.

17. Suspension and Project Cancellation

Where a project is delayed, suspended or cancelled, the applicable agreement determines how completed work, outstanding obligations, third-party commitments and payments are handled.

KCO may suspend work where agreed payment or essential cooperation requirements remain unfulfilled, subject to the applicable agreement and law.

Any cancellation charges or refund entitlements must reflect the agreed terms, work performed, applicable legal rights and relevant circumstances.

Neither party’s mandatory legal rights are removed by this section.

18. Website Security and Legal Responsibilities

KCO implements appropriate security measures within the approved development and infrastructure scope.

However, website security also depends on continued maintenance, supported software, properly managed credentials and responsible use.

The client remains responsible for the accuracy and legality of their business information, products, services and published content, except where particular obligations are expressly assumed by KCO.

Client-specific legal documents, consumer disclosures and regulatory compliance requirements must be identified and addressed as part of the agreed project scope.

KCO does not provide regulated legal advice merely by implementing website functionality or publishing client-approved legal content.

19. Managed Business AI

Managed Business AI is a separate KCO service family and is not automatically included with website development.

Where commissioned, its implementation and recurring operation require an approved scope, suitable KCO-managed infrastructure and applicable service terms.

AI capabilities, permissions, integrations, usage allowances and commercial conditions depend on the approved service arrangement.

Further information appears in our AI Assistant Disclosure & Usage Policy.

20. Limitations and Responsibility

KCO aims to deliver professional services with reasonable care and skill.

However, websites depend on changing technologies, browsers, hosting environments, third-party providers and external systems.

Specific guarantees, warranties, remedies and limitations are governed by the accepted agreement and applicable law.

Nothing in these terms excludes liability or legal protections that cannot lawfully be excluded or restricted.

KCO does not guarantee particular search rankings, visitor numbers, sales volumes or commercial outcomes unless a specific enforceable commitment has been expressly agreed.

21. Data Protection and Confidentiality

Personal information is processed according to applicable data protection requirements and the relevant controller or processor responsibilities.

Project information may include confidential business material, credentials and personal data requiring appropriate protection.

The parties are expected to handle such information responsibly and use approved channels for sensitive access details.

Additional confidentiality or data-processing obligations may be established in the applicable agreement.

For further information, consult our Privacy Policy.

22. Applicable Law and Changes

These terms are intended to operate in accordance with applicable Czech law and relevant European Union requirements.

Mandatory consumer, contractual and statutory protections continue to apply where relevant.

KCO may update its published terms prospectively. Existing accepted agreements are not automatically amended merely because public website terms are revised.

Any dispute is subject to the applicable rules governing jurisdiction and legal proceedings.
